Heating system installers are reluctant to install new gas boilers because of delivery problems. In addition, a ban on installation is expected to apply from January 2024. Guilds for heating installation companies have sample letters to reject customer requests. The industry sees this as further proof that the planned entry into force of the Building Energy Act is not practicable. From 2024 only the installation of heating systems that use at least 65 percent renewable energy. Pure oil or gas boilers are then excluded. Instead, hybrid systems with gas boilers and solar thermal systems or heat pumps are still permitted (Handelsblatt: 26.05.23).

In recent weeks, the debate surrounding the law has led many homeowners to want to buy new oil or gas heating systems. Many customers shy away from the higher costs of heat pumps or hybrid systems. They prefer inexpensive oil or gas boilers instead.
However, many politicians warn against this decision. Rising CO₂ prices and high gas prices could lead to a financial burden in the coming years. In addition, the use of the gas networks is becoming more expensive as the total number of gas users is falling.
Caution for installers of heating systems: Danger of high costs when ordering gas or oil boilers!
Installers who quickly order a gas or oil boiler for their customers now risk being stuck with the costs. This is the case when it is no longer possible to install the boiler this year.
In an email to its members, the Hesse Sanitary, Heating and Air Conditioning Technology Association warns of legal problems when installing fossil-fuelled heating systems. There is a “legal impossibility of providing the service” because the customer is released from his payment obligation, although the craftsman has to accept the heating system and pay the purchase price.
Deadline for fossil heating systems is ending soon – association warns of cost risk!
The association recommends only accepting an order for a purely fossil-fuel heating system if you are “absolutely certain” that the installation will be completed by December 31, 2023. A contract concluded before this date, but with an installation service beyond this date, is not sufficient.
The Association provides its members with a sample letter to respond to customer inquiries. It refers to delivery difficulties and the imminent installation ban, and no binding offer is made.
The Central Association for Sanitary, Heating and Air Conditioning (ZVSHK) calls for resilient transitional regulations and emphasizes that the entry into force of the Building Energy Act on January 1, 2024 is no longer practical in view of the fundamental changes.
The demand for gas and oil-powered devices is increasing significantly due to the uncertainty caused by the law, which contradicts the goal of ramping up heat pumps.
Some federal states and the FDP parliamentary group are pushing for the legislative process to be postponed or the law’s entry into force to be delayed.
